Introduction

conducts business through Fifty-five, this definition also applies to the

This includes any applications or websites that the FIFTY FIVE APP LIMITED Company may have on the Internet.
3.
The e-store used by the merchant in 1955 is referred to in this term as (The
E-store).
4.
Every consumer who buys the good or service from the dealer is referred to as a
consumer.
Article
2: Legal capacity of the trader
1.
The trader certifies that he is legally capable, that he is at least eighteen
years old in accordance with Kuwaiti laws and regulations, and that he has the
necessary knowledge to launch and run his online business through the age of
fifty-five.
2.
With the exception of subsection (1) of Article (2), a trader who is under
Kuwait's 18-year-old legal majority age may still engage in business, but he
must show evidence of his assent to the e-store and a declaration of approval
from his legal guardian. Legitimate if the situation calls for it.
3.
The trader declares that he is fully qualified and free of any
eligibility-related symptoms.
4.If
the trader registers as a business, organisation, or any other

3 - Fifty-Commitment: Five's 1. Fifty-objective Five's is to provide electronic
support tools by creating the e-store, and as such, Fifty-obligation Five's
under this Agreement is limited to setting up the trader's e-store at FIFTY
FIVE APP LIMITED and putting the e-store
in front of customers.
2.The
terms and conditions of this employment agreement apply to all FIFTY FIVE APP
LIMITED services, including any
marketing or guidance services, e-payment gateways, or other services that may
be offered to the trader or the online store.
3.
FIFTY FIVE APP LIMITED is not committed
to concluding the sale of goods or services between the customer and the online
store because its commitment only extends to the provision of e-store
construction services through Fifty-five, and it has no negative effects on the
other services that FIFTY FIVE APP LIMITED
still offers, such as advice, technical support, marketing, and payment
options.
4.FIFTY
FIVE APP LIMITED may, from time to time,
offer some e-stores free services, such as the trader's: Changing the
e-appearance store's or colours, at its discretion. These services are offered
by the management of FIFTY FIVE APP LIMITED
free, limited, and subject to particular limits. The trader must get in
touch with Fifty-technical five's support to learn more about offerings,
package costs, and other services if he wants further services.
5.
Since this transaction is a separate commercial relationship governed by the
agreement between the merchant and the consumer, FIFTY FIVE APP LIMITED has no connection to and is not liable for
any transactions between the trader and the consumer. Therefore, FIFTY FIVE APP
LIMITED has nothing to do with these
abnormalities if the customer refuses to pay for the service or item that the
trader gave.
6.All
transactions between the trader and the service providers (third party
services) that FIFTY FIVE APP LIMITED provides
linking with their services or offering their services to benefit the trader,
and the consumer, have no connection to FIFTY FIVE APP LIMITED because this transaction is a contractual
relationship independent from FIFTY FIVE APP LIMITED and subject to the agreement between the
trader and the service provider; as a result, if one of the parties fails to
comply with its agreed-upon terms or not fulfils them, the other party will be
in breach
7.FIFTY
FIVE APP LIMITED is not responsible for
any violations of the provisions of this agreement committed by the trader in
his e-store, and it has no involvement in any transactions between the trader
and the consumer.
Article
4 - Creation of the Online Store:
1.Anyone
who is of legal age may open an online store in accordance with the terms and
conditions of the employment contract, particularly "Article 1 - The
Trader's Legal Capacity."
2.
The e-store, which was created in line with the agreement to use Fifty-five,
must not violate Kuwaiti rules and laws, and the trader is required to specify
what kind of business he is engaged in and what goods or services he sells. And
FIFTY FIVE APP LIMITED deny guilt for a
transgression. The online store for Kuwait's public morality provisions. The
trader agrees under the terms of the agreement that his e-store does not
violate Kuwaiti public order or morals, and FIFTY FIVE APP LIMITED always reserves the right to refuse to
register any e-store that does not adhere to the laws and regulations
applicable in Kuwait or the requirements of this agreement.
3.The
e-store that is created through FIFTY FIVE APP LIMITED must adhere to the terms and conditions of
this employment agreement, and the trader also confirms that the physical store
that serves as the foundation for the e-store is compliant with Kuwaiti laws
and regulations.
4.No
one is permitted to use FIFTY FIVE APP LIMITED
if their membership or store has been terminated by Fifty-five, as well
as by official orders or court judgments.
5.If
an organisation registers as an institution, business, nonprofit, or legal
entity, such organisation is subject to all the guidelines and clauses in the
Employment Agreement of 1955.
6.
The information crime legislation, the Ministry of Commerce and Investment
regulations, the electronic transaction law, and the electronic commerce law
are only a few of the laws that apply to all e-stores and traders.
7.
The trader confirms that, prior to registering with Fifty-five, he confirmed
the availability of all the procedures and requirements necessary for his
participation in the e-store as well as the fulfilment of all such procedures
and criteria.
8.
If the trader applying to join and open the e-store is a "legal
person" individual trader, he or she is also required to verify and
provide the requirements specified by the official authorities in accordance
with the nature of the individual trader's activity, as the individual trader
acknowledges that he or she is committed to these requirements and is committed
to providing and processing them. The individual trader is also required to
provide their national identity number.
9.If
the trader requesting to join and open a shop on behalf of a company,
organisation, charity, or other legal entity, he is required to give FIFTY FIVE
APP LIMITED all necessary information
and documentation, including the e-commercial store's register and any other
documents needed for the e-registration store's and proof of private legal
identity. on the website.
Article
5 - Obligations regarding accounts and registration:
You
must provide particular information when applying to join FIFTY FIVE APP
LIMITED or to open an e-store, as well
as pick a secret username and password to use to log in to Fifty-five. You've
consented to the following after your account has been activated and you start
using FIFTY FIVE APP LIMITED services:
1. Be
in charge of protecting the privacy of your password and account information,
and you undertake to alert FIFTY FIVE APP LIMITED right once of any unauthorised use of your
account or any other breach of your personal information.
2. FIFTY
FIVE APP LIMITED disclaims all liability

3. You
must use your e-store yourself since you are totally responsible for it. If

4. You
must use FIFTY FIVE APP LIMITED with
seriousness and credibility, in accordance with the terms of the Employment
Agreement, and in accordance with all applicable laws and regulations in
Kuwait. You must also reimburse FIFTY FIVE APP LIMITED for any direct or indirect losses it may
suffer as a result of any improper or illegal use, and you must comply with all
applicable laws and regulations in Kuwait. Whether it is to perform services
using the username and password or as a result of your negligence to maintain
the confidentiality of your username and password, whether authorised by you or
not, anyone who has obtained access to your account in FIFTY FIVE APP
LIMITED may do so legitimately or
without authorization.
5. During
the registration process with Fifty-five, you are needed to provide true,
current, complete, and legal information about yourself. FIFTY FIVE APP
LIMITED is also required to update your
data if it changes or if doing so is necessary.
6. Avoid
including in your username any information that could be used to contact you,
such as phone numbers, email addresses, or other personal information, or any
assertion that you have a personal or professional connection to Fifty-five,
its staff, or its owners.
7. As
FIFTY FIVE APP LIMITED has nothing to do
with what you do in your e-store and is not accountable for your e-activity,
store's make no reference in your e-store to any direct or indirect
relationship between the e-store and Fifty-five, management, owners, or
employees.
8. In accordance with the rules of Fifty-privacy
five's policy, FIFTY FIVE APP LIMITED is
required to treat your personal information and contact information with strict
confidentiality.
You
will always be required to maintain and update registration data to keep it
true, accurate, valid, complete, and legal. If you disclose information that is
untrue, inaccurate, out-of-date, unlawful, or in violation of the terms of the
employment agreement, FIFTY FIVE APP LIMITED
has the right to halt, freeze, or terminate your membership or e-store
and account in Fifty-five, without compromising the rights and legal means of
recovering FIFTY FIVE APP LIMITED and
safeguarding other users. Whether directly or through a third party, FIFTY FIVE
APP LIMITED has the right to conduct any
investigations you deem necessary at any time, and to request that you provide
any additional information or documents of any kind to establish your identity,
the ownership of your funds, or the legitimacy of your account.The
administration of FIFTY FIVE APP LIMITED
has the right to halt, cancel, or block your membership or access to its
services if you fail to abide by any of the aforementioned conditions.
Additionally, it retains the right to terminate any unconfirmed activities,
accounts, or accounts that have lapsed for an extended length of time without
activity.
Article
6 - Forms of Official Communication:
1.
The trader in FIFTY FIVE APP LIMITED consents
to being contacted via email or by FIFTY FIVE APP LIMITED management to broadcast public communications
to all users or specific users once they visit their accounts within
Fifty-five. The trader further acknowledges in FIFTY FIVE APP LIMITED that any agreements, declarations,
statements, and other communications made electronically shall have the same
legal effect as if made in writing, and shall be conclusive evidence of the
parties' intent.
2.
During the course of your membership and trading with Fifty-five, FIFTY FIVE
APP LIMITED will send you promotional
emails to let you know about any upcoming modifications, policies, or marketing
campaigns.
Article
7: Fees for amending the employment contract
1.
You understand and acknowledge that FIFTY FIVE APP LIMITED will give you notice of any revision to this
Agreement that would result in a doubling of your obligations or a reduction in
your rights in compliance with any changes to this employment agreement.
2.You
acknowledge that FIFTY FIVE APP LIMITED has
the unrestricted right to modify this Agreement in any way, whether it be
fundamental or ancillary. Users will be notified of these modifications by any
means available, including email or by broadcasting a message to all Users. FIFTY
FIVE APP LIMITED will use technical
means to show that the e-store has accepted the amendment, which will be
binding on the e-store for the Agreement's terms.
3.We
hope you stop using FIFTY FIVE APP LIMITED
services if the amendment is not accepted because accessing your account
in FIFTY FIVE APP LIMITED or using FIFTY
FIVE APP LIMITED constitutes your
acceptance of modifications and full consent to ignorance, and FIFTY FIVE APP
LIMITED is happiest as a result. If you
object to any amendment to the employment agreement, this may make it difficult
for you to access the online store.
4.
Any fees are calculated in KD, and the trader is responsible for paying all KD
fees owed as well as any additional costs added by Fifty-five, provided that
payment is done using one of the authorised and specified methods offered by
Fifty-five.
5.Not
all packages and offers are cost-free for merchants or online retailers because
some of these packages and offers are subject to different prices.
6.Depending
on the offers or packages they choose, FIFTY FIVE APP LIMITED may impose fees for some e-stores or e-stores.
7.
No matter the reason for a user's registration, FIFTY FIVE APP LIMITED reserves the right to add, increase,
decrease, or deduct any fees or charges under the terms and circumstances of
the employment agreement.
Article 8 - Payment Services for E-Stores:
1.FIFTY
FIVE APP LIMITED offers a payment system
through its partners that can be completed totally online using payment choices
offered on FIFTY FIVE APP LIMITED or by
any payment method offered by FIFTY FIVE APP LIMITED from time to time.
2.
FIFTY FIVE APP LIMITED has nothing to do
with the method of payment upon receipt because this form of payment is
dependent upon the contractual arrangement between the customer, the trader,
and the service provider.
3.FIFTY
FIVE APP LIMITED reserves the right to
demand at any time and in any circumstance that payments be made directly
between the trader and the customer through their respective bank accounts,
even if there isn't currently any connection to Fifty-five.
4.In
order to facilitate and protect the interests of merchants and online
retailers, FIFTY FIVE APP LIMITED is
offering an online payment service.
5.The
merchant has a de facto obligation to set the price of the service or the goods
that he advertises in his online store in accordance with the established
market value; FIFTY FIVE APP LIMITED has
nothing to do with the misestimation of the cost of the goods or services
supplied in the online stores.
6.The
trader is required to provide invoices and receipt bonds for all amounts and
profits that arise in his online store, and is required to specify the type of
goods or services, quantities, descriptions, and value in all of these
invoices. The trader is also required to provide the necessary accounting specifications
in his online store in accordance with the terms of this Agreement, due to the
legal, economic, and commercial interests of the traders, as well as in the
e-commerce industry.
7.If
a technical error in FIFTY FIVE APP LIMITED
caused the price offered on FIFTY FIVE APP LIMITED to be lower than the market value of the
product, including a loss to Fifty-Five, FIFTY FIVE APP LIMITED has the right to stop any payment that is
made in violation of the rules and provisions of the employment agreement or to
cancel any order to buy or sell. FIFTY FIVE APP LIMITED is not responsible for those sums.
8.
Any payment method that has been made available on FIFTY FIVE APP LIMITED may be cancelled, modified, or changed at any
time by the administration of Fifty-five.
Article
9: Personal data and operational information
1.
By joining or setting up your e-store, through forms designated for
communication, you agree to provide FIFTY FIVE APP LIMITED an unrestricted, universal, permanent, and
non-reusable right, expense-free, licenced use of personal information or
materials, or other information provided or advertised on Fifty-five. Upon
registration, as well as through any email or communication method offered by
Fifty-five. to pursue any of Fifty-perceived five's hobbies.
2.FIFTY
FIVE APP LIMITED is merely allowing you
to view this material through FIFTY FIVE APP LIMITED and its advertising channels; you are solely
responsible for the information you provide or post.
3.
The "privacy policy" guidelines of FIFTY FIVE APP LIMITED apply to the confidentiality of e-store and
trader information.
Article
10 - Trader's Commitment to Comply with Kuwaiti Laws and Regulations:
1.
The trader agrees to abide by any Kuwaiti laws and regulations that may apply
to his products or to his use of Fifty-five, as well as any other laws that may
apply to the use of the Internet.
Copyrights
under Article 11:
1.All
written or spoken content on Fifty-Five, whether it is electronic or not. A few
examples include: The rights to all written and unwritten texts, graphic
designs, technical concepts, logos, presentations, icons, buttons, audio clips,
aggregated data, and electronic programmes are reserved for Fifty-five. No one
else is permitted to use these materials, whether directly or indirectly or
through a third party.
2.
The management of FIFTY FIVE APP LIMITED
warns that any trespassing or infringement of its property or
intellectual property rights will result in legal action.
3.FIFTY
FIVE APP LIMITED is not responsible for
any infringement of the registered e-stores or its members' intellectual
property rights.
Intellectual
Property Article 12:
1.
The administration of FIFTY FIVE APP LIMITED
respects the traders' intellectual property rights, whether they
possessed them before or after the foundation of the e-store, that they have
created through their e-stores.
2.
The Trader acknowledges and agrees that Fifty-five, and every right that
follows Fifty-five, is the sole and exclusive property of and is entitled to
all intellectual property rights in and to Fifty-five, including Fifty-five,
and the words, logos, and other symbols of FIFTY FIVE APP LIMITED or displayed on Fifty-five.
Article
13 - Consumer Protection: 1. FIFTY FIVE APP LIMITED explains the following to the proprietors of
e-stores in order to ensure that consumers get all of their purchases properly:
1. If
a customer uses one of Fifty-payment five's options to purchase goods but
doesn't receive them or does so with goods that differ from the specifications
listed on the e-store page, the customer has the right to inform Fifty-five,
and FIFTY FIVE APP LIMITED is free to
take whatever action it sees fit regarding the e-store that disobeyed the terms
of this agreement. FIFTY FIVE APP LIMITED
is not a party to the connection with the consumer, so it cannot be held
liable for this breach by the trader in front of the customer.
2. As
FIFTY FIVE APP LIMITED is not
responsible for the interaction between the customer and the trader, the
customer should check their purchases before receiving them to make sure they
are complete and match what was ordered.
3. Due
to Fifty-desire five's to preserve and protect the rights of all users and
registered with it, however, FIFTY FIVE APP LIMITED may take action against e-stores that

well as for any losses, malfunctions, or delays resulting from unavailable
goods, delayed delivery, or poor quality service from traders.
2.
FIFTY FIVE APP LIMITED will not accept
any claims resulting from mistakes or negligence, whether they were
intentional, unintentional, direct, or through a third party.
3.
FIFTY FIVE APP LIMITED disclaims all
responsibility for any claims or liabilities resulting from monetary losses,
slander, defamation, or any other damages brought on by the improper use,
misuse, or inability to use Fifty-five.
4.Fifty-five,
its officials, employees, or owners are not liable for any claim, dispute,
costs, damages, liability, or any loss, whether direct or indirect, suffered by
any party as a result of an action taken by a user of Fifty-five.
5.Fifty-five,
its workers, its owners, its representatives, and representatives have no
obligation to be a healthy, legal, and permitted product that complies with
Kuwaiti laws and regulations and isn't used for unlawful or unlawful
objectives. All goods and services offered in FIFTY FIVE APP LIMITED are offered by traders and their online
stores.
6.FIFTY
FIVE APP LIMITED is only responsible for
supplying the electronic support tools represented in the formation of the
e-store, and has no involvement with any illegal or irregular conduct carried
out by the e-store, any action that violates Kuwaiti laws, rules, or

7.

Article
15 - Information confidentiality:
1.FIFTY
FIVE APP LIMITED informs you that the
Internet is not a secure environment and that the privacy of personal data
cannot be completely guaranteed there.
2.
FIFTY FIVE APP LIMITED uses top-notch
(technical, regulatory, and concrete) standards to safeguard users and keep
their personal information or online stores safe from illegal access.
3.FIFTY
FIVE APP LIMITED has no control over any
third-actions, party's including those of other websites linked to FIFTY FIVE
APP LIMITED or independent contractors
purporting to speak for you and others.
4.
You understand and acknowledge that FIFTY FIVE APP LIMITED may use the information you submit to send
you marketing communications, to provide services to you in Fifty-five, and for
other lawful business purposes as described in Fifty-privacy five's statement.
Article
16 - Membership or E-store Cancellation FIFTY FIVE APP LIMITED may, in accordance with the employment
agreement and in accordance with Kuwaiti laws and regulations, resort to a
temporary or permanent suspension of the e-store, the withdrawal and
cancellation of the trader's membership, or the determination of the ability of
traders to access Fifty-services, five's if: 1. A trader violates the terms and
conditions of the employment agreement.
2.
If FIFTY FIVE APP LIMITED is unable to
validate any of the user data that has been given to it.
3.
If FIFTY FIVE APP LIMITED decides that
the user's actions violate the law or could put FIFTY FIVE APP LIMITED or other users in danger of getting into
trouble with the law.
4.FIFTY
FIVE APP LIMITED may choose to revive
suspended users. A user whose membership has been terminated or who has been
permanently suspended may not be able to register his e-store, access his
account, or use FIFTY FIVE APP LIMITED in
any way until he is given permission to reactivate his activity on Fifty-five.
However, FIFTY FIVE APP LIMITED reserves
the right to recover or claim any amounts owed to FIFTY FIVE APP LIMITED and any losses or damages caused by the
trader to Fifty-Five, and FIFTY FIVE APP LIMITED has the right to take legal action or resort
to the authorities as it deems appropriate. If the user violates this
employment agreement, FIFTY FIVE APP LIMITED
will also be entitled to any compensation.
5.
FIFTY FIVE APP LIMITED does not promise
to take any action in response to any violation of the Employment Agreement or
other similar acts of violation, and it does not forgo its right to do so.
Rather, this is up to the administration of FIFTY FIVE APP LIMITED and its legal management, who have the final
say.
Article
17: Sales, purchases, and payments:
1.
The trader is dedicated to running his online store successfully, keeping the
customer, and avoiding a conflict with the customer.
2.
The trader must use the payment methods permitted by this agreement to control
payments, sales, and purchases made through his online business.
3.Whether
or not payment has been received, FIFTY FIVE APP LIMITED reserves the right to reject or cancel
purchases. FIFTY FIVE APP LIMITED agrees
to notify the user of such action within five days by any means at its
disposal.
4.FIFTY
FIVE APP LIMITED states that it is
unrelated to any disagreements that may exist between the buyer and the seller.
Likewise, FIFTY FIVE APP LIMITED is
unrelated to any defaults made by the buyer towards the online store, including
payment defaults.
5.
The trader agrees and acknowledges that he will not use a credit card that does
not belong to him without authorization to purchase, make fictitious or
manipulative purchases on Fifty-five, or use an alias or other false personal
information. FIFTY FIVE APP LIMITED reserves
the right to take appropriate legal action against anyone who engages in such
fraudulent activities.
6.
FIFTY FIVE APP LIMITED states that all
e-stores and traders may be late in transferring some of the Funds due to
restrictions by the Monetary Authority, the Ministry of Commerce and
Investment, and e-cash. 6. All traders and all e-stores acknowledge their full
and unaccountable knowledge that the management of FIFTY FIVE APP LIMITED in transferring funds for their business
activities within FIFTY FIVE APP LIMITED
is subject to the authority and powers of the Monetary Authority of
Kuwait.
Article
18 - Prohibited Content
1.
As a trader in Fifty-five, it is your responsibility to prevent the publication
of any content that contravenes the company's privacy policies or this Usage
Agreement.
Kuwait's
Information Crimes System, Article 19:
Traders
are required to abide by all provisions of the Kuwaiti information crimes law,
and if they do, they are solely responsible for managing the situation. FIFTY FIVE
APP LIMITED is not held liable for any
violations of the rules that may apply, but it always reserves the right to
take whatever action it deems appropriate in the case of any e-store or trader
that disobeys the Kuwaiti information crimes law.
Article
20 - Limiting membership or access:
1.FIFTY
FIVE APP LIMITED reserves the right to
restrict a trader's access to FIFTY FIVE APP LIMITED services at any moment, without prior notice
and for any reason, without mentioning the rights of other traders.
Guaranty
under Article 21:
1.FIFTY
FIVE APP LIMITED does not guarantee the
repair of breakdowns or that the products offered by the traders are free of
any other defects, but is guaranteed by the e-store or the trader if the
warranty is mentioned and the length of the warranty is specified in the
product description, and the trader is required to uphold the standards of his
e-store.
2.
The online business is dedicated to creating a replacement and refund policy
that is exclusive to its online store and must adhere to the rules.
Article
22 - Responsibilities of the trader:
The
Trader agrees to accept responsibility for any damage that might befall FIFTY
FIVE APP LIMITED as a result of the
trader's transgressions and to hold Fifty-five, its employees, owners, or
subsidiaries harmless. The Trader is also required to waive any damage or to
stop any damage that might befall FIFTY FIVE APP LIMITED or one of its employees as a result of
claims, losses, losses, costs, expenses, or net fees. It was caused by the
trader's or the user's improper behaviour, which violated the Employment
Agreement or the Kuwaiti laws and regulations that were in effect at the time,
infringed on the rights of the trader or third parties, or resulted in a user

Article
23: The connection between traders and the Fifty-five:
1.Neither
the rules nor the provisions of this employment agreement contain any
indication that any trader and FIFTY FIVE APP LIMITED are in a partnership, and FIFTY FIVE APP
LIMITED does not permit any trader to
infer, directly or indirectly, that there is any kind of relationship, whether
direct or indirect, between him as a trader and Fifty-Five. Any notices that
the trader wishes to send to FIFTY FIVE APP LIMITED must be sent via email, and FIFTY FIVE APP
LIMITED will respond to the email.
Additionally, as a trader, you consent to receiving any messages from FIFTY
FIVE APP LIMITED via the email address
you gave the company when you registered.
Article
24 - Transfer of Rights and Obligations:
1.As a trader, you do not have the right to
object to management's activities toward Fifty-five, whether or not these
actions have an impact on Fifty-entity, five's obligations, ownership,
responsibilities, technical, or administrative actions. Furthermore, FIFTY FIVE
APP LIMITED is under no obligation to
tell you of any of these acts or of its pure will; nonetheless, FIFTY FIVE APP
LIMITED has the right to do so in
accordance with the guidelines and clauses of the Employment Agreement if it
deems it necessary.
Article
25 - Laws and regulations that apply:
1.
The laws, regulations, and legislation of Kuwait are fully regulated by this
employment agreement, which is governed and drafted in line with such laws,
regulations, and legislation.
Article
26 - Requirements for how the online store interacts with customers:
1.
The trader is dedicated to honesty and integrity in all interactions with
customers.
2.
The trader must act ethically when dealing with the customer.
Electronic
publications and offers by Fifty-five, Article 27:
1.
All paper and electronic advertising publications published on different
publishing platforms and through different social media networks are subject to
the terms and conditions of this usage agreement.
2.
FIFTY FIVE APP LIMITED uses the
magazines indicated as advertising collateral.
3.
Publications regarding the stability of prices for services, packages, or
offers are subject to change and are not enforceable against Fifty-five.
4.FIFTY
FIVE APP LIMITED reserves the right to
determine whether any user is eligible for this offer, to revoke it, and to
extend or shorten any offer it makes. All offers made by FIFTY FIVE APP LIMITED are temporary and are valid only for the time
period mentioned.
Strategic
and Logistics Services (Third Party Services) under Article 28:
1.Under
the terms and conditions of this employment agreement, FIFTY FIVE APP
LIMITED may use a third party to offer
some strategic or logistical services, including but not limited to shipping
company services or the delivery of items and goods.
2.
FIFTY FIVE APP LIMITED wants you to
understand that offering logistical or strategic services simply serves to
streamline your workflow with Fifty-five.
3.FIFTY
FIVE APP LIMITED lets you know that it
is only acting as a conduit between you, the user, and the service provider and
is not directly or indirectly liable for any decisions made by third parties
(third party).
4.FIFTY
FIVE APP LIMITED informs you that the
request for this service is optional and that it is based on the user's need
and desire. When a trader uses a third party service that FIFTY FIVE APP
LIMITED makes available, FIFTY FIVE APP
LIMITED disclaims all liability for the
relationship and the trader's agreement with the third party.
5.
Registered traders are recommended to review the terms of the service provider
(third party) and the costs of its services before confirming the service
request because certain strategic and logistics service providers impose their
own requirements or costs, over which FIFTY FIVE APP LIMITED has no control.
6.
If the user applies for a service offered by (third party), the user of this
act authorises FIFTY FIVE APP LIMITED and
permits it to give the service provider (third party) his data they (third
party) requests, and other data needed by the service provider (third party),
in accordance with the service provider (third party), and in accordance with
Fifty-privacy five's policy.
Article
29: Assistance with technology
In
line with the privileges of the package to which the e-store belongs, FIFTY
FIVE APP LIMITED provides some technical
support services for e-stores and traders under the terms and circumstances of
this employment agreement, such as:
1.
Free e-store control panels come with various free services.
2.The
trader must follow the terms of the packages and offers from Fifty-five, which
are frequently subject to a price, if they desire to add specific services,
different services, or numerous services.
3.
To assist e-stores in using FIFTY FIVE APP LIMITED and resolving technical issues that may
develop, FIFTY FIVE APP LIMITED enables
traders to interact with Fifty-technical five's support team.
Article
30: Conflict resolution
1.According
to the terms and conditions of this employment agreement, if a dispute arises,
it shall be handled by talks or an amicable settlement; if the dispute
persists, it shall be resolved by the Kuwaiti authorities.
1.
Free services are offered in an e-store control panel.
2.The
policy of packages and offers from FIFTY FIVE APP LIMITED must be followed, and there may be a price if
the trader wants to add specific services, different services, or multiple
services.
3.
In order to help e-stores navigate FIFTY FIVE APP LIMITED and address any technological issues that may
develop, FIFTY FIVE APP LIMITED enables
traders to get in touch with the company's technical support team.
Conflict
Resolution in Article 30:
1.According
to the rules and conditions of this employment agreement, if there is a
dispute, it will first be settled amicably or through negotiation. If the
dispute persists, it will then be resolved by the Kuwaiti authorities.
The
remaining articles, terms, conditions, and provisions of the employment
agreement remain valid until further notice from the administration of
Fifty-five. Article 31 - General Provisions: If any material or term in this
employment agreement is cancelled or any material or term in the employment
agreement is no longer applied, this does not negate the validity of the
remaining articles, terms, conditions, and provisions of the employment
agreement.
The
mechanism of action, understanding, agreement, and contract between the trader,
his e-store, and FIFTY FIVE APP LIMITED only
is set forth in this employment agreement, which may be amended from time to
time as necessary. The trader and his e-store are required to abide by the
terms of this agreement, and the trader agrees to bear the following in mind:
1.
Regardless of any legislative form, legal entity, institutional, commercial, or
charity action performed by the trader or e-store, this employment agreement is
valid for all users of Fifty-five, serves as the relationship's regulator, and
is the only contract between the trader and Fifty-five. The trader-consumer
relationship is governed by a separate legal arrangement and is subject to its
own checks and balances.
2.
The e-store must draught its employment contract in line with Kuwaiti laws,
rules, and regulations as well as those governing electronic transactions,
electronic commerce, and other trader-related activities.
3.Any
articles, terms, or provisions of Fifty-employment five's agreement may not be
imposed by anyone other than the company's management, and FIFTY FIVE APP
LIMITED is free to accept or reject
trader recommendations for this agreement.
4.The
Arabic text of the usage agreement remains the original in all transactions,
regardless of whether it is translated into any other language on FIFTY FIVE
APP LIMITED or elsewhere.
5.Only
a decision of the management of FIFTY FIVE APP LIMITED may cancel or change this employment
agreement.
